Import of Second Hand Capital Goods



As per the Foreign Trade Policy (Para 2.17 FTP) Second hand capital goods of any age can be imported freely subject to certain other restriction. 


The restriction imposed on import of second hand capital goods are:
•         Personal computers / laptops
•         Photocopier machines / Digital multifunction Print & Copying Machines
•         Air conditioners
•         Diesel generating sets
•         Re-furbished / re-conditioned spares having less than 80% of residual life (Para 2.33 of HBP ).

Except above all other second hand Capital Goods can be imported in to India without any restriction.

The importer of second hand capital goods is also eligible for claiming duty exemption benefit like EPCG, PROJECT IMPORT, EOU, SEZ.

The importer should get the Inspection Certificate from the Chartered Engineer of the country of export and give a declaration to the customs authority as per Policy Circular No. 4 (RE-2006)/ 2004-09 Date: 20.04.2006. Additionally the importer has to give the details of original purchase price , depreciation charged up to the period and the net value of the goods.

Customs clearance for Second Hand Capital goods requires Compulsory physical examination & report by the empaneled Chartered Engineer of the Port Customs Compulsory physical examination by Port Customs.
